Limitation of liability

To the maximum extent permitted by law, you acknowledge and agree that we are under no liability to you or any third party in relation to any loss or damage, including consequential loss or damage, however caused, whether by negligence or otherwise, which may be suffered or arise as a result of, the use of our images under Licence, or any content on our website and collateral materials.

Nothing in these terms excludes, restricts, modifies any condition, warranty, right or remedy which is conferred on you by law. Where any law implies any condition or warranty into these terms of use which may not be lawfully excluded, then to the maximum extent permitted by law, our liability for breach of the warranty will, at our option, be limited to the re-supply of the relevant service or the payment of the cost of having that service re-supplied.

Indemnity

You shall indemnify e3 Global against any and all liabilities, which e3 Global or its directors or employees incur or may incur arising out of or in connection with the Challenge entrant’s act, default or omission or breach of the Terms and Conditions.

To the extent permitted by law e3 Global shall not be under any liability to the Challenge entrant in respect of any loss or damage (including, without limitation, consequential loss or damage) howsoever caused, which may be suffered or incurred or which may arise directly or indirectly in respect of the supply of Challenge services or the act, failure or omission of e3 Global.

Service Provision

e3 Global Pty Ltd will:
a.perform Challenge services with care and diligence and in a professional manner to the best of its knowledge and expertise;
b.comply with all relevant laws
c.promptly and fully inform the Challenge entrant about all matters affecting, or likely to affect your Challenge participation, which comes to e3 Global’s attention

Service Provision

As a condition of your use of the Licence under this Agreement, you warrant to e3 Global that you will not use e3 Global copyright materials for any purpose that is unlawful or prohibited by these terms & conditions or any other terms, conditions or notices appearing anywhere on e3 Global communications. You agree to abide by all applicable laws and regulations.

In particular, you agree not to:

• use the e3 Global and Green Tick logo to defame, abuse, harass, stalk, threaten or otherwise offend others;

• publish, distribute, e-mail, transmit or disseminate any material which is unlawful, obscene, defamatory, indecent, offensive or inappropriate;

• use any automated scripting tools or software;

• engage in or promote any surveys, contests, pyramid schemes, chain letters, unsolicited e-mailing or spamming via e3 Global or the Green Tick;

• impersonate any person or entity;

• upload, post, e-mail, transmit or otherwise make available using e3 Global and the Green Tick any material that you do not have a right to make available under any law or contractual obligation or which contains viruses, or other computer codes, files or programs designed to interrupt, limit or destroy the functionality of other computer software or hardware;

• breach any applicable laws or regulations.

Copyright in the material available at this site is owned by the e3 Global Pty Ltd and third parties and may only be used in the ways described in this legal notice: • you may take temporary copies necessary to browse this site on screen • unless otherwise stated, you may download or print a single copy of e3Global copyright material for research or personal use • you must not change any of the material or remove any part of any copyright notice.
